CORAM: R.D. DHANUKA & SUNIL K. KOTWAL, JJ.

DATE: 19.09.2017 ORDER :

1] Heard learned counsel appearing for the parties. 2] By this civil application filed by the six applicants, they seek their impleadment as party respondent nos.115 to 120 in Writ Petition No.3608/2010.

- 2 - 3] Learned counsel for the applicants invited our attention to the averments made in the civil application and would submit that the applicants are also selected and appointed in the process of selection pursuant to the advertisement dated 21.1.2009, which selection procedure is subject matter of this writ petition. He submits that the original writ petitioner has applied for setting aside the entire selection procedure and thus if any order is passed by this Court in the writ petition, the rights of the applicants would be prejudiced or may be affected otherwise.

4] We have perused the averments made in the civil application as also the prayers made in the writ petition.

5] We are of the view that if any orders are passed by this Court in Writ Petition No.3608/2010, as prayed, the rights of the applicants to this civil application may be seriously prejudiced or affected. In our view, the applicants have thus made out a case for their impleadment as party respondent nos.115 to 120 to the Writ Petition No.3608/2010.

6] The original writ petitioner is directed to

- 3 - implead the applicants as party respondent nos.115 to

120. Amendment be carried out within a period of two days from today.

7] It is made clear that the applicants would be permitted to rely upon the averments made in the civil application and the annexures to the civil application in support of the oral arguments they propose to make before this Court to oppose the writ petition.

8] The civil application is disposed of in aforesaid terms. No order as to costs.
