This is the Application for condonation of 1759 days delay in preferring the First Appeal by the Orig. Claimant for further enhancement of the amount in the land acquisition proceedings. 2.

The learned Advocate for the Applicant submits that sufficient reasons are shown in the Application which prevented the Applicant from filing the Appeal within the stipulated time. He submits that the Application be allowed.

The learned AGP for Respondent Nos.1 and 2 and the learned Advocate for Respondent No.3 / Acquiring Body oppose the Application and submit that no sufficient reasons are shown in the Application. They submit that the Application be rejected. 4.

On hearing all the sides and for the reasons mentioned in para nos.2 to 5 of the Application, the Application is allowed in terms of prayer clause 'B'. The Applicant shall not be entitled to the statutory

benefits and the interest for the aforesaid delayed period. Copy of this order be kept in the order sheet of the Appeal Memo. Application stands disposed off accordingly.
