The Application is filed by the Orig. Claimant for condonation of 1759 days delay in preferring First Appeal for further enhancement of the amount of compensation in the land acquisition proceedings. 2.

The learned Advocate for the Applicant / Orig. Claimant submits that sufficient reasons are mentioned in the Application and the Applicant will not claim interest and statutory benefits for the delayed period and the Application may be allowed.

The learned AGP for Respondent Nos.1 and 2 and the learned Advocate for Respondent No.3 oppose the Application. They submit that sufficient reasons are not shown in the Application and the Application may be rejected.

On hearing both the sides and for the grounds mentioned in paragraph nos.3 to 5 of the Application, the Application is allowed in terms of prayer clause 'B'. The Applicant shall not be entitled to interest and statutory benefits for the aforesaid delayed period. Copy of this order be kept in the order sheet of the Appeal Memo. Application stands disposed off accordingly.
