DATE : 8th APRIL 2015 ORDER:

1) The report given by the learned Judicial Magistrate, First Class, Nanded shows that direction was given to the police to make investigation under section 202 of the Code of Criminal Procedure. But said report is not yet received. It also shows that application Exhibit 12 is filed by the present applicant in the said proceeding and the present applicant has prayed for dismissal of the complaint, closure of the case in view of decision given by

2 Cr Application 4638/2014 the Civil Court in his favour. The said application is still pending.

2) In view of these circumstances, this Court holds that there is no need to decide the present matter. If felt necessary there is liberty for the applicant to come to this Court again after decision of the Judicial Magistrate in the said matter.

3) The Judicial Magistrate is expected to take decision on Exhibit 12 and also on the point of issue process within two months from today. The Investigating Officer is also expected to file report before that date in the Court. Authenticated copy be supplied to both sides. Learned Additional Public Prosecutor to inform the concerned police station accordingly. The application is disposed.
