...RESPONDENTS Mrs. Renuka V. Ghule-Palve, Advocate for petitioners Mr C.V. Dharurkar, Asstt. Govt. Pleader for respondent CORAM : NITIN W. SAMBRE, J.
DATE: 11th September, 2017
(2) ORAL ORDER :
The Registrar (Judicial) vide order dated 6th June 2016 had granted one week time to remove office objections by way of last chance; and thereafter refused the registration. The said entry of refusal of Registration has taken on 20th June 2016 by the office in appropriate register, which order is questioned in this application, seeking restoration of the petition.
2.
The learned Counsel for the petitioners submits that it is due to personal difficulty of the applicant (since she was not well), she was unable to remove office objection). She undertakes to remove office objections within a period of two weeks from today, provided this Court grants indulgence. She volunteers that she would pay cost of Rs. 1000/- (Rs. One thousand only) to the High Court Bar Library, within a period of two weeks from today.
3.
In the wake of above, issuance of notice to the respondent is dispensed with as this Court is passing innocuous order, that is not detrimental to the interest of the respondent. As such, notice to the respondent is dispensed with. Delay of 29 days caused in preferring this application is condoned after hearing learned Asstt. Govt. Pleader. The order dated 20th June 2016 refusing registration is hereby quashed and
(3) set aside.
4.
If objections are not removed within period of two weeks from today, order rejecting registration shall govern the matter. 5.
With above observations, the application stands allowed. ( NITIN W. SAMBRE, J.) pjm
