The Insurance company has deposited an amount of Rs.70,53,790/- in this Court.

(a) Considering the fact that two claimants are minors, we direct deposit of an amount of Rs.20,00,000/- (Rs. twenty lacs) each, i.e. total amount of Rs.40,00,000/- for the benefit of minors, to be invested in a fixed deposit in a nationalized Bank initially for a period of three years with a further direction to renew the fixed deposit receipts for a further period until disposal of the appeal. (b) Out of the balance amount of Rs.30,53,790/-, the claimant no.1 Manisha Ramesh Paighan shall be permitted to withdraw Rs.20,00,000/- (Twenty lacs) on condition of tendering an undertaking to this Court to the effect that in the event of success of appeal, she will deposit the amount in this Court within a period of twelve weeks from such decision.

BENCH AT AURANGABAD (2) CA NO.9272/2015 (c) The balance amount of Rs.10,53,790/- shall be invested in a fixed deposit in any nationalized Bank initially for a period of three years with a further direction to renew the said fixed deposit for further period un-till disposal of the appeal. With the directions as above, civil application stands disposed of.
