IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 8940 OF 2019 Shivaji Pundlik Pophale .. Petitioner

Versus

The State of Maharashtra and others .. Respondents Shri V. D. Gunale, Advocate for the Petitioner. Shri P. G. Borade, A.G.P. for the Respondent No. 1. CORAM : S. V. GANGAPURWALA AND MANGESH S. PATIL, JJ.

DATE : 22ND JULY, 2019.

FINAL ORDER :

.

This Court had passed an order in the writ petition filed by the petitioner earlier with regard to the payment of the amount. Thereafter, the petitioner had filed contempt petition. The statement was made by respondents that amount has been paid to the petitioner. The petitioner had raised a grievance that the amount is paid less. In the contempt petition this Court observed that, the petitioner may take appropriate steps in that regard. The petitioner thereafter has filed instant petition. 2.

In fact, this Court would not adjudicate as to the exact amount due and payable by the respondents to the petitioner. In

2 wp 8940.19 that context, we had disposed of the contempt petition. 3.

In our opinion, the petition would not be maintainable now for the same relief again.

4.

If the petitioner feels that there is short fall in the payment of amount, the petitioner may file proceedings before the Civil Court or before any other forum as may be permissible in law. 5.

The writ petition is disposed of. No costs.
