IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.8906 OF 2025 DATTAJI VASANTRAO JAWALE

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for the Petitioner : Mr. Shailesh S. Chapalgaonkar Addl. G.P. for Respondents: Mr. A.R. Kale ...

CORAM

: MANISH PITALE & Y. G. KHOBRAGADE, JJ.

DATE : 15.09.2025 PER COURT:

1.

This petition is filed by the petitioner challenging communication dated 12.06.2025, issued by the Bhartiya Rashtriya Shikshan Sanstha, Lohara of which the petitioner appears to be an employee. The petitioner has also challenged a further communication dated 10.07.2025 issued by the said institution. Both these communications call upon the petitioner to show cause as to why appropriate action should not be taken against him and the second communication even indicates the constitution of an inquiry committee. 2.

While challenging these communications, the petitioner is also seeking a direction to the Assistant Charity Commissioner for disposing of pending change reports. Copies of documents placed on record show that the Information Officer of the office of the Charity Commissioner, communicated to the petitioner that change reports with regard to the said institution/trust are pending adjudication before the Assistant Charity Commissioner.

2 46.WP.8906.25.odt 3.

We fail to understand as to the basis on which the petitioner has directly approached this Court under Article 226 of the Constitution of India challenging the said communications. Under the garb of challenging the said communications, the petitioner is seeking a direction to the Assistant Charity Commissioner to decide the change reports while the petitioner neither claims to be member of the Trust or an office bearer of the same. 4.

No case is made out for invoking writ jurisdiction in the facts and circumstances of the present case and hence we are inclined to dismiss this writ petition.

5.

Accordingly, the petition is dismissed. Pending applications, if any, are also disposed of.
