In that view of the matter, he seeks leave to withdraw the present application with liberty to file fresh bail application before the trial court in view of subsequent filing of charge sheet.

3. Criminal application is dismissed as withdrawn with liberty as prayed for. It is made clear that the case of the present applicant was not heard at all on merit by this Court.
