Learned AGP submits that the R & P was in fact, transmitted to the Maharashtra Revenue Tribunal. An affidavit is tendered by Shrikumar Baburao Chinchkar dated 7.2.2018 who is present in the Court. An apology is tendered. Learned AGP further clarifies that the SDO did not retain the R & P with him as it was already forwarded to the MRT. Pursuant to the order of this Court dated 19.1.2018, the said R & P is collected from the MRT and produced today and is delivered to the learned AGP.

Considering this explanation, it cannot be said that the SDO can be faulted. He is permitted to draw TA/DA for attending the Court proceedings today.
