By this application, the applicant is seeking transfer of HMP No.A429/2020 pending before the Family Court, Aurangabad. 3.

Learned counsel for the applicant submits that the applicant has been studying at Nanded since 2020. It is not possible for her to travel from Nanded to Aurangabad which is less than 300 kms. He submits that the applicant's parents are old and they cannot accompany her to Aurangabad. He, therefore, seeks transfer of said HMP to Nanded. 4.

Learned counsel Shri Jadhav for the respondent-husband vehemently opposed the petition. He submits that the applicant is the

( 2 ) 977 mca 202.21 resident of Ranjangaon, Tq. Gangapur, District Aurangabad. Summons was also served at the same address. Just to harass the respondent, this petition has been filed.

The respondent has placed on record the notice of HMP No.A429/2020 in which the address of the petitioner is shown as Ranjangaon, Tq.Gangapur, District Aurangabad. Learned counsel Shri Jadhav submits that notice of the petition was served to her on this address. Learned counsel for the applicant submits that notice was accepted by the brother of the applicant. However nothing is placed on record to indicate that she is not the resident of Ranjangaon, Tq. Gangapur, District Aurangabad. In this view of the matter, the application is misconceived and hence it is dismissed. [M.G. SEWLIKAR, J.] mub
