Heard rival submissions. The applicants are seeking withdrawal of entire compensation amount which has been deposited by the State- acquiring body. The learned AGP strongly opposed the application on the ground that the learned Reference Court has granted almost 15 times compensation than the compensation awarded by the Special Land Acquisition Officer. 2.
On the contrary, the learned counsel for the claimants pointed out that the land under acquisition is situated in Fulambri which is well developed area. In view of the same, following order is passed :-
ORDER
(i) The applicants are permitted to withdraw 50% of the deposited amount along with the accrued interest thereon by furnishing usual undertakings before the learned Registrar ( Judicial ) of this Court and 25% of the deposited along with the accrued interest thereon by furnishing Solvent Surety / Security.
(ii) The remaining amount be invested in F.D.R. in any Nationalized Bank on yearly renewal basis till final disposal of this appeal.
(iii) The application accordingly disposed of.
