On 25.8.2023, we have passed the following order :- "1. The petition is bereft of material information, like (a) the quantum of pension being received by the family owing to the death of the father in an accident on 04.10.2016, (b) the quantum of compensation received under the Motor Vehicles Act, (c) the amount of gratuity received by the family, (d) the amount of retiral benefits received by the family, (e) the Petitioner is 31 years of age and whether he is married and has a family/ children.

2. In view of the above, we direct the Petitioner to file an additional affidavit to set out details regarding the above points, along with record available. Let such an affidavit along with documents be filed on or before 08.09.2023.

The Petitioner has filed an additional affidavit in view of the aforesaid order. It is stated in paragraph no.3 that the family gets a pension of Rs.35,000/- per month The mother of the Petitioner received gratuity amount of Rs.8,00,000/-. The 5 heirs of the deceased employee received compensation of Rs.64,00,000/- in the Motor Accidents Claim Tribunal Case. The Petitioner is married after the demise of his father and has 2 daughters aged 8 years and 3 years. The family has 1 1⁄2 acres of ancestral land.

At this juncture, the learned Advocate for the Petitioner submits on instructions that the Petitioner desires to withdraw this Petition.

The Petition is disposed off, as withdrawn.
