The petitioner who is a Peon appointed by respondent no. 4 - management in the respondent no. 5 - school, is challenging the decision rendered by the respondent no. 2 in his capacity of chairman of the committee constituted under the government resolution dated 20-03-2019, thereby refusing to include his name in the Shalaarth Pranali for disbursal of the salary only on the ground that he is appointed from the scheduled tribe category but has not submitted the tribe validity certificate. It is also pointed out that his proposal is pending with respondent no. 6 for verification of the tribe certificate.

Since it is not in the hands of the petitioner to get the proposal pending with respondent no. 6 decided, having worked as a Peon, he cannot be deprived of the salary.

We, therefore, dispose of the petition by directing respondent no. 6 - scrutiny committtee to decide the petitioner's proposal as expeditiously as possible and in any case within four
(4) months.

Till the time, respondent no. 2 shall pass appropriate order for including petitioner's name in the Shalaarth Pranali co-terminus with the decision of respondent scurity committee and contingent upon that decision.
