Mr Kudale, learned Counsel for the petitioner submits that the application Exh.5 for grant of temporary injunction is already withdrawn. According to him, the present petition be permitted to be withdrawn with liberty to move application under Order XXVI, Rule 9 of the Code of Civil Procedure at an appropriate stage of recording evidence.
