Respondent no.2 has filed affidavit stating that the dispute has been amicably settled and she is giving consent for the quashment of the proceedings. It is also stated that the divorce petition is pending before the Family Court at Aurangabad and a sum has been deposited by the husband before that court.

In view of the fact that the applicants stood prosecuted for the offences punishable under Sections 498-A, 323, 504, 506, 354 r/w 34 of IPC which is arising out of the matrimonial dispute and now it is settled, this is a fit case where we should exercise our inherent powers under Section 482 of Cr.P.C. Hence, the application stands allowed in terms of prayer clause [B].
