IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.9735 OF 2015 Martha Joseph Bagul PETITIONER

VERSUS

Satej Anton Bagul & others RESPONDENTS .......

Mr. K. N. Shermale, Advocate for the petitioner .......

[CORAM : SUNIL P. DESHMUKH, J.] DATE : 30 th SEPTEMBER, 2015 ORDER :

1.

The petition has been moved purportedly challenging an order dated 22nd November, 2011 annexed to the petition at Exhibit-C, page 40.

2.

Learned advocate for the petitioner makes strenuous effort to justify such a belated approach.

3.

However, looking at that appeal is pending, the order impugned does not require to be faulted with. As such, the petition is not being entertained and stands rejected for laches as well.

4.

It is being submitted by learned advocate for the

{2} wp9735-15 petitioner that the appeal is pending from 2010 and is ripe for hearing.

5.

Learned advocate for the petitioner urges for directions to dispose of the appeal as early as possible, preferably within a period of three months. Such a request can be made by the petitioner.

6.

It is pointed out that already an application has been filed by the petitioner for expeditious disposal, I deem it that it would be expedient, if the request of the petitioner for expeditious disposal of the appeal is considered having regard to aforesaid circumstances and pendency of appeal since 2010 and age of the petitioner, who is stated to be a widow.
