Heard Mr A.M. Gaikwad, learned counsel for the applicants and Mr A.B. Kadethankar, learned counsel holding for Mr Rathi for respective sides.

Perused the record. There seems to be delay of 763 days in filing the appeal.

Mr Kadethankar, learned counsel for the respondent opposed to condone delay.

The applicants have assigned sufficient reasons for condonation of delay in their application, more particularly, in para No. 3. Certain arguable points are involved in the proposed appeal, and therefore, I am of the considered view to condone the delay in the interest of justice.
ORDER
