PER COURT :- The learned Advocate for the applicant points out that, the matter between the parties was settled in the National Lok Adalat held on 8.4.2019 by the High Court Legal Aid Services Sub-committee at Aurangabad. The Appeal from order No.97/2016 was taken-up at Sr.No.23 and settled between the parties. Paragraph No.2 of the compromise terms dated 8.4.2017 indicates that, the applicant would receive, in all, an amount of Rs.8 lakhs. She has received Rs. 6 lakhs. Rs.1 lakh were to be deposited by 10.4.2018 and remaining Rs. 1 lakh were to be deposited by 10.4.2019. Rs.1 lakh deposited were withdrawn in 2018 and thus the last installment is to be withdrawn. The learned Advocate appearing on behalf of the respondents consents that this application can be allowed and Rs. 1 lakh can be withdrawn.
In view of the above and by recording the consent of the respondents, Civil Application is allowed.
The applicant shall withdraw Rs.1 lakh deposited in this Court, on the same terms and conditions, as were applicable when she withdrew Rs.1 lakh last year.
