Petitioner's proposal for up-gradation is stated to be pending with the respondent No. 2/Deputy Director of Education. 2.

We have heard both the sides.

Even if it is, as is informed by the learned A. G. P., a case wherein the petitioner has, without having any permission admitted the students and is liable to some penalty, nothing is happening. The proposal has been kept pending. No independent or any other action is apparently initiated. Merely pointing out that petitioner has illegally admitted some students, would not suffice.

We dispose of the writ petition by directing the respondent No. 2 to consider the petitioner's proposal for up-gradation on its own merits as expeditiously as possible and in any case within a period of six (06) weeks from today.
