1] The present Application is filed by the applicant - wife seeking transfer of the Petition A / HMP No. 452 of 2022 from the Family Court, Pune to the Family Court at Latur.
2] Though the respondent is served, none has entered appearance on behalf of the respondent. 3] The learned counsel for the applicant submits that the marriage between the applicant and respondent was solemnized in the year 2019. On account of certain dispute, the applicant is presently residing with her parents
at Latur. The marriage of the applicant with the respondent was performed at Latur. The learned counsel for the applicant further submits that the applicant has no source of income. The learned counsel for the applicant further submits that the distance between Latur to Pune is 350 to 380 kilo meters. It is difficult to the applicant to attend the proceedings at Pune. The learned counsel further submits that the respondent husband is a private contractor and the respondent can attend the proceedings at Latur. The learned counsel for the applicant further submits that considering the aforesaid facts, the present application may be allowed.
4] In view of the submissions made, the present Misc. Civil Application is allowed in terms of prayer clauseB, which reads as under : B. The proceeding bearing Petition A / HMP No. 452 of 2022 dated 24.02.2022 filed by the respondent - Husband for Divorce against the applicant under Section 13 (1) (i-a) of the Hindu Marriage Act, 1955 in the Court of Family Judge at Pune may kindly be transferred
to the Court of Family Court at Latur having jurisdiction in the interest of justice;
5] The Misc. Civil Application is disposed of accordingly.
