Present application has been filed under Section 482 of the Code of Criminal Procedure for quashing the FIR bearing Crime No.952 of 2022 dated 12.11.2022 registered with M.I.D.C. Waluj Police Station, District Ch. Sambhajinagar (Aurangabad) for the offences punishable under Sections 279, 337, 338 of Indian Penal Code. The said FIR is stated to be registered by respondent No.4. 2.

Heard learned Advocate for the applicant, learned APP for respondent Nos.1 to 3 - State and learned Advocate for respondent No.4.

Upon the submissions on behalf of respondent Nos.1 to 3 i.e. learned APP and upon the police papers, it now emerges that though the FIR was against the applicant, but after the investigation, the charge-sheet is filed against respondent No.4. It is filed before the learned Judicial Magistrate First Class, Aurangabad. Taking into consideration this aspect, question of quashing the FIR as against the applicant does not arise. 4.

Application, therefore, stands disposed of.
