Heard. This application is filed for condonation of delay of 3689 days caused in filing the appeal. Since the appeal is by the original claimants for enhancement of the amount towards acquisition of their landed property, this Court is inclined to allow the application. However, at the same time, it is necessary to impose certain costs as the the delay is of almost about 10 years. 02.

Therefore, the application is allowed and delay is condoned subject to costs of Rs.3500/- (Rupees Three Thousand Five Hundred) to be deposited in the office of High Court Legal Services Sub-Committee, Aurangabad within four weeks from today. Needless to say that the applicants shall not be entitled to receive any interest for the delayed period in case the amount of compensation is enhanced. The appeal be registered. [KISHORE C.
