The learned counsel for the petitioner submits that by order dated 27.02.2020, this Court (Coram : Ravindra V. Ghuge, J.) has disposed off both the Writ petitions with a leave to the petitioner to file a fresh application for leading

secondary evidence on or before 31.03.2020. It is further stated that failing which, the petitioner shall lose the right of filing such an application. It is also observed that if such an application is filed within a time prescribed, the Tribunal shall decide the said application, as expeditiously as possible, in any case, on or before 30.06.2020. The learned counsel for the petitioner submits that due to lockdown declared in the said area, the petitioner could not file the application within time as directed by this Court. The petitioner thus seeks extension of time by filing the Civil Applications.

The learned counsel appearing for the other side including the learned counsel for the respondents-original claimants have no objection, if the time is extended, firstly for one month for filing an application to lead the secondary evidence and secondly, another month thereafter for disposal of the said application by the Tribunal.

In view of the above, the Civil Applications are allowed in terms of prayer clause 'B' and one month time is extended for filing an application to lead the secondary evidence and

upon filing such an application, the Tribunal shall decide the same thereafter within a period of one month. 4.

This Court has also directed the Tribunal to dispose of both the pending Motor Accident Claims on or before 31.12.2020. Needless to say that the said period is also extended for a further period of three months. 5.

Both the Civil Applications are accordingly disposed off. (V. K. JADHAV, J.) ...
