The learned counsel accepts that due to passage of time, this Writ Petition has become infructuous. The petitioners were elected as members of the Managing Committee of Hattarwadi Society and the term was expired on 04.08.2007. They were trying to hold the elections of Managing Committee, however, the elections could not be held due to drought conditions. The Constitution of the Agricultural Produce Market Committee, Manwat was required to be made and the 11 members of the Market Committee were to be elected by the Managing Committee of the registered Agricultural Credit Co-operative Societies and Multi Purpose Credit Co-operative Societies. Accordingly the provisional Voters List was prepared

916-WP.6863-08.odt and published by District Deputy Registrar on 04.07.2008 by issuing a notification. By order dated 07.10.2008, the Assistant Registrar, Co-operative Societies, Manwat passed the orders and superseded the Managing Committee of the Hattarwadi Society by taking aid of Section 77-A of the Maharashtra Co-operative Societies Act, 1960. Being Aggrieved by the same, the petitioners have preferred the revision / appeal before the Divisional Joint Registrar, Cooperative Societies, Aurangabad. Though it is pending, the District Deputy Registrar, Co-operative Societies and the District Returning Officer has deleted the names of the petitioners from the final list of the voters by issuing the list of the deleted members.

The Rule was granted by this Court vide order dated 12.12.2008 without granting any interim relief. 3.

Thus, by passage of time, this Writ petition has become infructuous. The Writ petition is hereby dismissed as infructuous. Rule discharged. Writ petition is accordingly disposed off.
