Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.40 of 2024 registered with Sonkhed Police Station, District Nanded for the offences punishable under Sections 302, 498-A, 323 r/w 34 of the Indian Penal Code.

The sister-in-law of the applicant has lost her life in the incident due to 'smothering with constriction of neck, associated with evidence of head injury'. The applicant resides at Gadchiroli. Coincidentally, he had been to the village on the day of the incident. The incident happened within the four walls of the house. However, no weapon has been recovered from the applicant. No other incriminating material has also been recovered from him. The accused has a case that only father-in-law and the victim were in the house. She did not

952-ba-1357-2024.odt (2) state the incident to her brother when he reached to her. Considering the role attributed to the applicant and the absence of any incriminating material against him, he may be granted bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Balaji Pundalik Mudgule, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant should not tamper with the prosecution witnesses and should attend the trial on each and every date.
