1] Heard.
2] The present applications are filed by the applicants for suspension of substantive sentence imposed on them in Session Case No.18/2021 and Sessions Case No.34/2014, dated 04.07.2025, by learned Sessions Judge, Bhokar. The applicants have been convicted thus: "1) The accused no.1 Gajanan Subhash Angarwar and accused no.2 Santosh @ Banti Ramchandra, are convicted for the offence punishable under Section 326 read with section 34 of the Indian Penal Code vide section 235(2) of the Code of Criminal Procedure and they are sentenced to suffer regorous imprisonment for three years and to pay fine of Rs.1,000/- (Rs. One Thousand only) each in default to suffer rigorous imprisonment for six months. 2) The accused no.1 Gajanan Subhash Angarwar and accused no.
2 Santosh @ Banti Ramchandra, are convicted for the offence punishable under Section 324 read with section 34 of the Indian Penal Code vide section 235(2) of the Code of Criminal Procedure and they are sentenced to suffer rigorous imprisonment for one year and to pay fine of Rs.1,000/- (Rs. One Thousand only) each in default to suffer rigorous imprisonment for three months. 3) The substantive sentences imposed upon the accused Nos.1 and 2 shall run concurrently."
3] Considering that the maximum sentence is of 3 years, the sentence can be suspended.
4] Considering the above, I pass the following order :
ORDER
i] Criminal Appeal No.533 of 2025 and Criminal Appeal No.586 of 2025 are admitted.
ii] Call R & P with paper book.
iii] Criminal Application No.2684 of 2025 and Criminal Application No.2961 of 2025 are allowed. iv] The substantive sentence imposed on the applicants in Session Case No.18/2021 and Sessions Case No.34/2014, dated 04.07.2025, by learned Sessions Judge, Bhokar, stands suspended till the final hearing and disposal of Criminal Appeals.
v] The applicants be released on bail on furnishing P.R. bond of Rs.20,000/- each with one or two sureties in the like amount to the satisfaction of the trial court. vi] Bail before the trial Court.
