Heard the learned counsel for the applicants and the learned A.P.P. for the respondent/State.

The applicants are seeking bail in Crime No. 62 of 2023 registered with Police Station Osmannagar, District Nanded for the offences punishable under Sections 307, 323, 504, 506 read with Section 34 of the Indian Penal Code.

The facts of the case reveal that parties were quarrling over the land and that was the cause for the incident. It was a stone pelting. The stone and bricks allegedly used in the crime have been recovered from the spot of the incident. The injured has been discharged from the hospital. The reasons best known to the Investigating Officer, why the statement of the injured has not been recorded. Be that as it

935- BA-1239-2023.odt may, considering the substantive investigation in the crime as well as cause for quarrel no purpose would be served keeping the applicants behind bar. Hence, the following order :-

ORDER

(i) The application is allowed.

(ii) Applicant No.1 Govind Dadarao Shinde and applicant No.2 Suresh Ramchandra Kadam be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) each, with one solvent surety in the like amount, in connection with the above crime, on the conditions that (a) They shall not tamper with the the prosecution witnesses. (b) They shall attend the concerned Police Station as and when called on written notice by the Investigating Ifficer, till filing the charge sheet.

(c) They shall stay away from village Halda, Taluka Kandhar, District Nanded, for three months from the ate of their release. ( S. G. MEHARE ) JUDGE ysk
