The applicant herein is charge-sheeted for an offence punishable under section 302 of the Indian Penal Code, for causing death of one Chandabai Zumbar Jadhav, with whom he has entered into loan transaction and from the accusation, it appears that the applicant has failed to repay the said debt.

The cause of death cited by the Medical Officer is septicemia due to 68% burns.

Deceased Chandabai suffered burns at the house of the present applicant and her two dying declarations are recorded. Both the dying declarations are consistent, prima facie pointing finger of involvement of the present applicant.

In view thereof, no case for grant of bail is made out. 5.
