DATE :- 12th June, 2017 P.C.:

*2* 35.wp.8438.16.group On the basis of the compensation awarded by the Reference Court by it's judgment and award dated 02.05.2014, the Petitioners and some others sought modification in the compensation awarded to them. Rather they sought enhancement on the basis of the awards of the Reference Court. This was a right created by Section 28-A of the erstwhile Land Acquisition Act, 1894. That was sought to be enforced and exercised and by making applications and enclosing therewith relevant documents. Inaction on the part of the State in not deciding such applications is the subject matter of these petitions. There is no affidavit denying the contents of the petitions or annexures thereto.

The notice was issued on these petitions way back on 10.08.2016. There was enough opportunity for the contesting parties to place their version on record. There being no such contradicting material nor any denial of statement of facts, we direct consideration of these applications expeditiously. All the pending applications in these petitions shall be duly considered and disposed of as expeditiously as possible and preferably by 31.08.2017.

The Writ Petitions are, accordingly, disposed of. kps (MANGESH S. PATIL, J.) (S.C. DHARMADHIKARI, J.)
