IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 11246 OF 2018 SANDEEP SUBHASH GOMLADU

VERSUS

SUNITA SANDEEP GOMLADU ...

Advocate for the Petitioners : Shri V. R. Nawathe ...

CORAM : RAVINDRA V. GHUGE, J.

DATED : 09th OCTOBER, 2018.

...

PER COURT :

1.

The petitioner/husband is aggrieved by the grant of Rs. 3,000/-(Rs. Three Thousand only) as interim maintenance to the respondent/wife vide order dated 22/12/2017. 2.

I have heard the learned Advocate for the petitioner for quite some time and have considered the grounds formulated by him in the memo of the petition.

3.

Though the petitioner has attempted to contend that he has no annual income, the fact remains that he has an agricultural land and it is the contention of his wife that he has an annual income of about Rs. 4,00,000/- to 5,00,000/-. The

914-wp-11246-18.odt petitioner claims that the child born out of the wedlock is depending upon him and his aged parents are also his responsibility.

4.

I am, however, unable to be convinced that the amount of Rs. 3,000/- (Rs.Three Thousand only) granted by the Trial Court as interim maintenance to the wife could be termed as being an exorbitant amount or that it is beyond the means of the petitioner.

5.

In view of the above, this petition, being devoid of merit is, therefore, dismissed.
