FARAD CONTINUATION SHEET NO.

IN THE HIGH COURT OF JUDICATURE AT BOMBAY

APPELLATE SIDE, BENCH AT AURANGABAD WRIT PETITION NO.9739 OF 2016 Namdeo Bapu Thakur Vs. The State of Maharashtra and others. Office Notes, Office Memoranda of Coram, appearances, Court's orders or directions and Registrar's orders.

Court's or Judge's orders Mr.S.D.Tawshikar, advocate for the petitioner. Mr.B.A.Shinde, A.G.P. for the State.

CORAM : S.V.GANGAPURWALA AND K.L.WADANE,JJ.

Date : 21.09.2016.

PER COURT :

1.

Heard.

2.

Issue notice to the Respondents.

3.

Learned A.G.P. waives notice for Respondent Nos.1 and 4. 4.

In fact, the present Writ Petition ought not to have been filed at all. The order passed by us in W.P.No.7108/2015 dated 31.7.2015, is abundantly clear. Vide the said order, we had directed the Scrutiny Committee to decide the validation proceedings within one year and we had granted protection to the services of the petitioner till the validation proceedings are pending and decided. 5.

According to the learned counsel for the petitioner, letter has been issued to the petitioner to submit the validity at the earliest by the Superintending Engineer. We have gone through the said

letter. The said letter nowhere states that on non-submission of validity certificate, the services of the petitioner would be terminated. The said letter only reiterates that the petitioner should submit the validity at the earliest.

6.

As our order in W.P.No.7108/2015 dated 31.7.2015 grants protection to the petitioner till disposal of the validation proceedings, no need to pass any fresh orders. 7.

The Writ Petition is accordingly disposed of. No costs. (K.L.WADANE,J.) (S.V.GANGAPURWALA,J.) Dt.21.09.2016.
