Present Application has been filed for quashing the First Information Report (for short "the FIR") vide Crime No. 1140 of 2023 registered with Kotwali Police Station, Taluka and DistrictAhilyanagar (Ahmednagar), on 22nd September, 2023,- for the offence punishable under Sections 406, 409, 417, 419, 420, 465, 467, 468, 471, 120-B of the Indian Penal Code and Sections 66-C and 66-D of the Information Technology Act, and further proceedings, if any, arising out of the same. 2.

Heard learned Advocate Mr. G.R. Syed for the applicants, learned APP Mr. Pulkundwar for respondent No.1 and learned Advocate Mr. Narwade for respondent No.2.

Learned Advocate appearing for the applicants and learned Advocate appearing for respondent No.2 submits that during the pendency of the application, the parties have amicably settled their dispute.

The parties have arrived at the compromise and compromise terms have been filed. The terms of compromise are got verified by the learned Registrar (Judicial), who then submitted report on 12th November 2025. It has been stated in the compromise, that with the intervention of the senior members of the society, both the parties have amicably resolved the dispute between them, which was the family dispute. Taking into consideration the terms of compromise, we find that this is a fit case where we should exercise our powers under Section 482 of the Code of Criminal Procedure. However, since the entire machinery has been utilized for family dispute, we impose the costs. Hence, we pass following order:-

O R D E R

(I) The Application stands allowed.

(II) The the First Information Report (for short "the FIR") vide Crime No. 1140 of 2023 registered

with Kotwali Police Station, Taluka and DistrictAhilyanagar (Ahmednagar), on 22nd September, 2023, for the offence punishable under Sections 406, 409, 417, 419, 420, 465, 467, 468, 471, 120-B of the Indian Penal Code and Sections 66-C and 66-D of the Information Technology Act, and further proceedings, if any, arising out of the same, stands quashed and set aside as against applicant Nos. 1 to 5 i.e. - 1) Dattatray Tulshiram Raskonda, - 2) Vinayak Dattatray Raskonda, - 3) Shriniwas Dattatray Raskonda, - 4) Vishal Dattatray Raskonda and - 5) Shriniwas Hanmantu Myana.

(III) Applicant Nos.1 to 5 to deposit cost of Rs.25,000/-, each, with the High Court Legal Services Sub Committee, Aurangabad, on or before 22nd December 2025.

(IV) Place the matter for compliance on 9th January 2026.
