1] Shri Kale, learned counsel for the petitioner submits that the proceedings which are subject matter of challenge in the present writ petition were also subject matter of challenge in W.P. No. 2842 of 2007, filed by other petitioners. This Court, vide judgment and order dated 31st August, 2009, has allowed the said writ petition and set aside the said acquisition proceedings . According to the learned counsel, subsequent to the judgment dated 31st August, 2009 passed in W.P. No. 2842 of 2007, fresh acquisition proceedings were initiated, same are also quashed by this Court in a separate writ petition.

2] In view of the above, nothing remains for adjudication in the present writ petition. Present writ petition is disposed of in terms of the order dated 31st August, 2009, passed in WP. No. 2842 of 2007. No costs. [A.M. BADAR] [S.V. GANGAPURWALA] JUDGE JUDGE grt/-
