The applicants are praying for disbursement of amount deposited by the respondent-insurance company, for the reasons stated in the application. It is contested by the respondent-insurance company. 2.

It is brought to my notice that arising out of same accident, two first appeals have been filed, wherein claimants were permitted to receive 60% of the amount on furnishing undertaking by a common order dated 25.04.2025. The deceased in those matters are of the same age group. I propose to follow the same course of action.

In the present case, the respondent-insurance company deposited an amount of Rs. 14,31,811/-, besides statutory deposits of Rs. 25,000/-. The applicants are entitled to receive 60% of the amount for the time being. 4.

The Civil Application is allowed partly by permitting the applicants to receive 60% of the amount with accrued interest on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court for the time being.
