Applicants are seeking their impleadment in the proceedings at the place of respondent Nos.1 and 2 who are original plaintiffs. They purchased suit property vide sale deed dated 17.12.2012 from respondent Nos.1 and 2. They are necessary party.

The averments in the applications are not controverted. Second appeal is pending for admission.

A separate application bearing civil application No.9499 of 2025 is filed to bring heirs of one of the purchasers Abdul Shakur Abdul Gufran Pinjari. However, he was not party to the proceedings and he is directed to be made party by present minutes of order. Therefore, it needs to be clarified that he be impleaded through his heirs.

For the reasons stated in Civil Application No.12012 of 2022, it stands allowed by impleading them as party by substituting them in place of respondent Nos.1 and 2. Necessary amendment shall be carried out within a period of two weeks from today.

Civil application No.9499 of 2025 is disposed of as heirs of deceased purchaser is permitted to be impleaded. (SHAILESH P. BRAHME, J.) ...
