This is Civil Application seeking condonation of delay of 1240 days caused in filing present First Appeal. 2.

Mr. Mr. Shaikh Mazhar A. Jahagirdar, learned Advocate for the applicant submits that the delay is not out of lethargy or any negligence on the part of the applicant/appellant. He therefore seeks condonation of the delay.

Mr. V. V. Patil, learned Advocate for respondent in all fairness submits that respondent has no objection if the delay is condoned and the appeal is heard on its own merit. 4.

In the light of above, I pass following order:

ORDER

a.

Civil Application stands allowed.

b.

Delay of 1240 days caused in filing appeal is hereby condoned.

c.

Applicant/appellant to remove all the office objections, if any, within two weeks from today. d.

Subject to removal of all office objections, Registry to register the First Appeal.
