Heard learned Counsel for applicant/wife who is seeking transfer of Petition A-443 of 2021 fled by the respondent/husband for getting divorce pending in the Family Court, Latur to the Court of Civil Judge, Senior Division, Biloli, Dist. Nanded.

According the applicant, she has also fled Criminal Miscellaneous Application No. 31 of 2022 for getting maintenance under Section 125 of Criminal Procedure Code and it is pending in the Court of learned J.M.F.C., Degloor. Moreover, a criminal prosecution under Section 498-A of I.P.C. lodged at the instance of applicant is also pending Pooja K.

{2} 998-MCA-220-2022 before the learned J.M.F.C., Degloor and the respondent has appeared therein.

As such, it appears that, the respondent/husband though remained absent despite service, he will have to come to Degloor in any circumstances. Therefore, considering the convenience of applicant/wife following order is passed.

ORDER

a.

The application is hereby allowed.

b.

The Petition No. A-443/2021 pending in the Family Court, Latur is hereby transferred to the Court of learned Civil Judge, Senior Division at Biloli, Dist. Nanded for disposal according to law. c.

The respondent/husband is directed to appear before the learned C.J.S.D. Biloli, Dist. Nanded on or before 12th December, 2022.

d.

The application accordingly disposed of.
