The Commissioner of the Municipal Corporation filed a pursis in the proceedings initiated by the petitioner under Section 81(B) of the Maharashtra Municipal Corporation Act, that petitioner will not be evicted without due process of law. Mr. S.S. Bora, the learned counsel appearing for Municipal Corporation submits that the petitioner has not been issued any notice as yet. In the light of that the petition is without any cause of action.
