BENCH AT AURANGABAD WRIT PETITION NO. 12041 OF 2017 HAIDAR ALI MIR BABAR ALI VERSUS THE DIVISIONAL CONTROLLER, MSRTC AND ANOTHER ...

Advocate for Petitioner : Shri Khandelwal Rajesh K. ...

CORAM : RAVINDRA V. GHUGE, J.

Dated: October 03, 2017 ...

PER COURT :- 1.

The petitioner has challenged his dismissal dated 21.10.2002 by filing a Complaint (ULP) along with an application for condonation of delay. By the judgment of the Labour Court dated 17.2.2015, the application was rejected. By judgment dated 14.6.2017, Revision (ULP) No. 32 of 2015 filed by the petitioner has been dismissed. 2.

Learned counsel for the petitioner seeks leave to withdraw this petition, so as to raise an industrial dispute under Section 2A of the Industrial Disputes Act, 1947.

3.

Considering the above, this petition is disposed off as withdrawn with liberty to prefer an industrial dispute under Section 2A of the said Act. The time spent by the petitioner in the Labour Court from 23.2.2006 till the passing of this order shall be a good ground for condonation of delay, if any, in entertaining the industrial dispute.
