Learned counsel Shri. Bedre submits that he has instruction to file appearance for legal heirs of deceased respondent No.1-d-1, but he has no instruction to appear for legal heirs of respondent No. 5. So, issue notice to proposed legal heirs of respondent No. 5 in Civil Application No. 9964/2012, made returnable on 23.10.2015. Hamdast allowed. 2.

The learned counsel for appellant submitted that Civil Application No. 10118/2012 is yet to be decided. There is no such civil application on the record. He is to produce copy of such application. The learned counsel has produced the copy of civil application. Copy is taken on record. There is possibility that the application must have been allowed. If it is not allowed, it is allowed.
