Heard learned Counsel appearing for the applicants and the learned Counsel appearing for the Insurance company.

Having regard to the contentions raised in the application for withdrawal of the amount and the objections raised in exception to the impugned judgment, I deem it appropriate to pass following order:

ORDER

1.

The applicant no.1 is permitted to withdraw a sum of Rs.25,00,000/- ( Rs. twenty five lacs), for and on behalf of all applicants from the deposited amount on furnishing an undertaking that in the event any adverse AGP/-

IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD (2) CA NO.12560 of 2016 order is passed, she will re-deposit the said amount so withdrawn by her within four months of passing such order.

The remaining deposited amount be invested in Fixed Deposit Receipt in any nationalized Bank for the period till disposal of the appeal.

Civil Application for withdrawal of amount stands disposed of.
