At the outset, learned counsel for the Applicant pointed out to this Court that the parties i.e. applicant and informant were referred to mediation and mediation is successful. Compromise terms are placed on record. He makes a solemn statement that the informant and her husband are cohabiting peacefully now. Compromise terms placed on record are supported by statement on oath of the informant.

This Court, therefore, finds no reason to disbelieve compromise between the parties. Since the incident has allegedly arisen out of matrimonial dispute and as the informant herself

- 2 - aba1197.23.odt claims that compromise has taken place, there is no reason to discard the said compromise. Moreover, on the face of it, offence punishable under Section 307 is not attracted. Hence, application is allowed in view of compromise and in terms of interim relief. ( R. M. JOSHI) Judge dyb
