Applicant apprehends arrest in connection with with C.R. No. 418 of 2023 registered with Shevgaon Police Station, Dist. Ahmednagar for the offences punishable under Sections 307, 353, 332, 333, 336, 143, 147, 148, 149, 427 of the Indian Penal Code and Sections 4 and 25 of the Arms Act and Section 7 of Criminal Law (Amendment) Act and Section 3(1) of Prevention of Damage to Public Property Act.

Learned Counsel for the Applicant submits that co-accused are already granted anticipatory bail by this Court. He drew attention of the Court to the FIR Umesh

931-ABA-1192-2023 II.odt wherein no overt-act has been alleged against present Applicant 3.

Learned APP opposed the application.

From the FIR it appears that it is the case of a mob violence. There are no specific allegations against present Applicant of committing any overt-act in the said incident. Undisputedly, co-accused with similar role are already enlarged on anticipatory bail. Hence, there is no reason to not to apply parity. Hence, application is allowed by confirming interim order dated 24.07.2023.
