Learned counsel for the applicant, on instructions, seeks leave to withdraw this application with liberty to the applicant to file an application for regular bail before the trial Court after filing of the charge sheet. Learned counsel however submits that the charge sheet is yet not filed as the inquiry report is awaited. Learned APP, on instructions from the Investigating Officer, submits that the inquiry is concluded and the charge sheet would be filed withing 4 to 5 days. Learned counsel for the applicant submits that the court below has rejected the application of the applicant seeking regular bail mainly on the basis of the observations vre/-

927-BA-1399-2020.odt made by this Court in Anticipatory Bail Application No. 36 of 2020 filed by the present applicant.

In view of the above submissions, leave granted. The application is disposed of as withdrawn with liberty to the applicant to file an application for regular bail before the trial court after filing of the charge sheet. Upon filing such application, the trial court shall decide the application on its own merits without getting influenced by the observations made by this Court while disposing off the anticipatory bail application since the parameters for deciding anticipatory bail applications and the regular bail applications are altogether different.
