The Petitioner is aggrieved by an order passed by the Education Officer, refusing the change in school record claimed by the petitioner on the ground that the proposed change of caste as well as name cannot be permitted under Rule 26.4 of the Secondary School Code, 2015. 2.

It is correctly pointed out by the learned counsel appearing on behalf of the respondents that under Clause 15 of Appendix VI to the said Rules, an appeal against the order of Education Officer is provided before the Deputy Director of Education.

In view of the same, learned counsel for the Petitioner, on instructions, seeks permission to withdraw the petition with liberty to file an appeal before the said Appellate Authority.

Hence, the petition is disposed of as withdrawn, with liberty to the

If the appeal is filed before the Appellate Authority, considering the urgency of the matter, the Appellate Authority i.e. the Deputy Director of Education, is directed to decide the appeal as expeditiously as possible and, preferably, within four weeks from today.
