I have heard learned counsel for the applicant for some time. Learned counsel for the applicant, on instructions, seeks leave to withdraw this application. Learned counsel for the applicant however submits that the applicant is in jail in connection with the present crime since 10.01.2016 and even though the charge was framed way back in the year 2016 itself, the trial is yet not commenced. Learned counsel submits that necessary directions may be given to the trial court for expeditious hearing and disposal of the case.

In the year 2016, the applicant had filed Criminal Application no. 3802 of 2016 before this Court for regular vre/-

912-BA-1401-2020.odt bail and this Court (Coram : N. W. Sambre, J.) has disposed off the application as withdrawn.

I have carefully perused the report submitted by the trial court in compliance with the directions given by this Court. It appears that the learned Judge, who is in-charge of the said court, could not proceed with the trial due to the pandemic situation. However, there is no mention in the report to indicate as to what happened prior to taking over the charge of the said court right from the year 2016. 4.

In view of the above, leave granted. The application is disposed off as withdrawn. The trial court is hereby directed to dispose off the case bearing Sessions Case No. 34 of 2016 within five months, by day to day hearing, if possible. The trial court shall submit a fortnightly report to the Sessions Judge, who shall monitor the expeditious disposal of the case as directed by this Court.
