Learned Advocate for the petitioner submits that this petition was directed against the order dated 16.07.2016, passed by the learned 2nd Joint Civil Judge, Senior Division, Ahmednagar, below exhibit 17 in RCS No. 52/2016, rejecting the petitioner's application for appointment of Commissioner which was admittedly before the framing of the issues. He submits that he will withdraw this petition and liberty may be granted to file such application, if need be so at appropriate stage.

In view of the above submissions, the petition stands
