Present application has been filed for setting aside the conditional order passed by this Court on 27-06-2019 and restoration of the civil application which was for condonation of delay in filing the second appeal.

Heard learned Advocate Mr. Manale S. S. for applicant and learned Advocate Mr. R. P. Adgaonkar for respondent. The learned Advocate for respondent has strongly opposed the application. 3.

Present applicant had filed the civil application for condonation delay, however, he had not taken steps to serve the unserved respondents and, therefore, conditional order passed by this Court on

CA 13684-2019 27-06-2019 and granted two weeks time. No steps were taken during that period and, therefore, it was treated that the application is dismissed. Now the applicant is giving the fresh address of those respondents who were unserved. Under such circumstances, application stands allowed in terms of prayer Clause "B". Application stands disposed of.

It appears that though this Court had directed learned Advocate Mr. Adgaonkar to file his Vakalatnama within a period of one (1) week by order dated 06-08-2021, it appears that he has not yet filed his Vakalatnama till today. He should file the Vakalatnama within a period of one (1) week.
