This is an application for bail under Section 439 of Code of Criminal Procedure. The applicant has been arrested in connection with Crime No. 425 of 2022 registered with M.I.D.C. Police Station, Dist. Ahmednagar for the offences punishable under Sections 394, 411, 504 and 506 read with Section 34 of the Indian Penal Code. 2.

Heard. Perused the First Information Report ("F.I.R.") and related police papers.

The offence is triable by the Court of Judicial Magistrate First Class. The applicant has not played any overt act in the offence in question. 1 / 2

969-BA-1307-22.odt For little over two months the applicant is behind the bars. Co-accused have been granted bail. The applicant is twenty one years of age. For all these reasons, the Court is inclined to grant him bail. 4.

In view of above, the application deserves to be allowed. Hence I pass the following order :-

ORDER

(I) The bail application is allowed.

(II) The applicant be released on bail, in connection with Crime No. 425 of 2022 registered with M.I.D.C. Police Station, Dist. Ahmednagar for the offences punishable under Sections 394, 411, 504 and 506 read with Section 34 of the Indian Penal Code, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. (III) The applicant shall mark his presence in M.I.D.C. Police Station, Ahmednaga once a week i.e. on every Sunday by 12:00 noon for next eight months.

(IV) The applicant shall not tamper with the prosecution evidence.
